Partiamo subito con l’affermare che, allo stato dell’arte, non sussistono particolari ragioni per negare la legittimità dell’assemblea condominiale da svolgersi in modalità mista. Detto ciò, occorre però precisare che ad essa si devono applicare anche tutte le disposizioni recentemente introdotte per l’assemblea a distanza: in particolare dovrà essere raccolto il consenso preventivo di tutti i condomini allo svolgimento dell’assemblea nella suddetta modalità; dovrà essere indicata la piattaforma digitale tramite la quale si svolgerà l’incontro; il verbale dell’assemblea dovrà essere sottoscritto dal presidente.
Per quanto riguarda, invece, la parte in presenza dell’assemblea, sarà cura dell’organizzatore procedere all’adeguamento del luogo prescelto alle normative in materia di prevenzione del contagio da Covid-19 e della conseguente predisposizione di tutti gli strumenti necessari allo svolgimento della riunione.
