Ci si domanda cosa succede se un condomino non esegue in modo corretto la raccolta differenziata; la domanda riguarda chi debba essere ritenuto responsabile della violazione dal punto di vista amministrativo. Si hanno il singolo condomino, da un lato, e il condominio nel suo complesso, dall’altro. Il tribunale di Torino, nella sentenza del 1° marzo 2018 afferma la responsabilità del singolo perché la responsabilità di chi commette un’infrazione è personale, ed inoltre perché il condominio non è obbligato a vigilare sui bidoni e su cosa vi viene conferito all’interno. Secondo il tribunale milanese il colpevole sarebbe il condominio perché è il soggetto che, nella veste di proprietario dei contenitori, è titolare del rapporto nei confronti del Comune nella cura della raccolta differenziata.
Nelle città in cui la raccolta differenziata è a pieno regime, i condomini, al pari dei proprietari di abitazioni individuali, devono gestire e custodire i contenitori forniti dall’ente locale competente e provvedere alla loro manutenzione, compreso il lavaggio.
L’amministratore in qualità di mandatario dell’edificio, come tale responsabile, deve:
• comunicare ai condòmini le regole da rispettare in materia di vigilanza, conservazione e utilizzo dei contenitori,
• indicare in quali parti di cortili e aree private devono essere collocati i bidoni;
• specificare, nel rispetto del regolamento comunale, a quale distanza è necessario posizionare i recipienti rispetto a porte e finestre.
Ci si interroga su cosa succeda se uno o più condomini non eseguono in modo puntuale la raccolta differenziata. La domanda inerisce alla multa irrogata dal Comune, a carico di chi deve essere emessa.
Il tribunale di Torino libera il condominio dall’obbligo di pagare la multa irrogata dal comune perché, al pari di quanto accade in ambito penale, la responsabilità di chi viola una norma di diritto amministrativo è personale. Non si può di conseguenza chiedere all’ente condominio di porre attenzione su quello che i singoli condomini ripongono all’interno dei bidoni per la raccolta differenziata.
Pare ostativo in questo senso l’art. 3 della legge n. 689/1981 che sancisce che <
Per il tribunale di Milano (decisione n. 1047 de 13.2.2018) invocando l’art. 6 della stessa legge n. 689/1981, si reputa che il condominio sia tenuto a rispondere solidalmente al pagamento della multa con il singolo condomino colpevole.
La disposizione normativa di base di questa decisione prevede che <
Nel caso di specie, la multa è stata irrogata al condominio, per l’impossibilità d’ individuare esattamente il trasgressore persona fisica. Il giudice milanese ha altresì affermato che il condominio nel suo complesso è responsabile perché spetta a lui, nella veste di proprietario dei contenitori, interfacciarsi con il Comune per la raccolta differenziata. A lui spetta quindi curare la raccolta, non si può chiedere ai singoli di riporre personalmente i rifiuti nei contenitori. L’unico rapporto che lega infatti il Comune con i vari condòmini riguarda il pagamento della tassa per il servizio comunale.

Il primo attiene alla Corte di legittimità (Cass. 7890/1999) nel caso di specie il Supremo Collegio ha affermato che se c’è un danno e questo danno non è riconosciuto da alcuno dei condòmini come conseguenza di una propria azione/ omissione, <
Per quanto concerne l’eventuale responsabilità solidale per mancata raccolta differenziata, il Giudice di Pace di Napoli, con la sentenza del 31.08.2016, ha accolto il ricorso presentato da un cittadino/condomino annullando l’ordinanza di ingiunzione emessa dal Comune.
La motivazione è la seguente: la multa disposta al cittadino non deve solo indicare gli estremi dell’illecito, ma anche identificare, con precisione, il soggetto colpevole.
Secondo il giudice adito «la responsabilità non può essere attribuita al nucleo familiare, né tantomeno al capo famiglia se la condotta illecita l’ha commessa un altro convivente”; infatti, la legge è chiara: “risponde della sanzione solo chi materialmente ha commesso l’azione».
Quindi, secondo questo ragionamento, l’autorità amministrativa, in caso di violazione di raccolta differenziata (senza identificazione del trasgressore) non può, per ciò solo, inviare la multa al titolare dell’appartamento che paga la tassa sui rifiuti (sulla presunzione che sia stato questi a non osservare l’ordinanza comunale sulla differenziata), ma deve identificare, in modo puntuale, chi ha commesso l’illecito.
